1. About these terms

These Terms of Service apply to your use of modernchevalier.com (the "Site") and to any purchase you make from Modern Chevalier ("we", "us", "our"), a business based in Ottawa, Ontario, Canada. By using the Site or placing an order, you agree to these terms, our Privacy Policy, our Shipping Policy, and our Return and Refund Policy. If you do not agree, please do not use the Site.

2. Using the Site

You must be at least the age of majority where you live to place an order, or have a parent or guardian do it for you. Use the Site only for lawful purposes. Do not interfere with the Site, try to get around its security, copy it with automated tools, or use it to commit fraud.

3. Accounts

If you create an account, give us accurate information and keep your login details private. You are responsible for activity on your account. Tell us promptly if you think someone has used it without your permission. We may suspend an account that is used to break these terms.

4. Products and descriptions

We try to describe and show our products accurately, but we cannot promise that every description, image, colour or size is error-free. Colours can look different on different screens. Please use our Size Guide where one is shown. Most products are produced or sent by third-party partners, and we may change or stop selling a product at any time. References to other companies' products or brands, such as watch models that a band fits, are for compatibility only. We are not affiliated with those companies.

5. Prices and payment

Prices are in Canadian dollars (CAD). Taxes and shipping are added at checkout unless a price says otherwise. We can change prices at any time, but a price change does not affect an order you have already placed. If a product is listed at the wrong price because of an obvious error, we may cancel the order and refund you in full, even after it was confirmed. Payments are handled by Shopify and its payment providers. By placing an order you confirm that you are allowed to use the payment method and you authorize us to charge it. We do not store your full card number.

6. Orders

Your order is an offer to buy. We accept it when we send you a shipping confirmation. An order confirmation email only tells you we received it. We may refuse or cancel an order, for example because of stock, pricing errors, an address we cannot deliver to, or suspected fraud. If we cancel an order you have paid for, we will refund you. We may limit the quantity of items per order.

7. Shipping, returns and cancellations

Shipping, returns, refunds and cancellations are covered by our Shipping Policy and our Return and Refund Policy. Those policies form part of these terms.

8. Using products safely

Follow the instructions and warnings that come with your product. Children's products have age recommendations and may have small parts, so choose them for the right age and supervise young children. For electronic products, use the chargers and batteries as the manufacturer directs, and do not use them in situations where being distracted could cause harm, such as when driving. We are not responsible for harm caused by using a product against its instructions.

9. Discounts and promotions

Discount codes and offers have the conditions stated with them. They can end or be withdrawn at any time, cannot be combined unless we say so, and have no cash value.

10. Our content and intellectual property

The Site's text, images, designs, logos, and the Modern Chevalier name belong to us or our licensors. Do not copy, republish, sell or use them for commercial purposes without our written permission. Buying a product does not give you any right to the artwork or design on it, other than the right to use the product itself.

11. What you send us

If you send us reviews, messages or other content, you promise that you have the right to share it and that it is not unlawful, misleading or offensive. You give us a non-exclusive right to use it to run and promote the store. We may remove content that breaks these terms.

12. Third-party services and links

The Site relies on third parties such as Shopify, payment providers and shipping carriers, and may link to other websites. We do not control them and are not responsible for their content, policies or practices.

13. Disclaimer

To the extent the law allows, the Site and its content are provided "as is" and "as available". We do not promise that the Site will always be available or error-free. Nothing in these terms removes any condition, warranty or right that you have by law and that cannot be excluded, including under consumer protection and sale of goods legislation.

14. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profit or data, arising from your use of the Site or our products. Our total liability for any claim connected to an order is limited to the amount you paid for that order. This does not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

15. Privacy

We collect and use personal information as described in our Privacy Policy.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over disputes, subject to any right you have under mandatory consumer protection law to bring a claim where you live.

17. Changes to these terms

We may update these terms from time to time. The version posted on the Site, with its "last updated" date, applies to orders placed after that date.

18. General

If part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term, that is not a waiver of it. These terms and the policies they refer to are the whole agreement between you and us about your use of the Site and your orders.
